Terms of Service

Welcome to Scope Flow. These Terms of Service (“Terms”) govern your use of the Scope Flow website and services (the “Service”), operated by Scope Flow (“Scope Flow”, “we”, “us”, or “our”). By using the Service, you agree to these Terms. If you don’t agree with them, please don’t use the Service.
What Scope Flow does
Scope Flow is a lead-matching service. We connect New Zealand businesses looking for web design services (“Customers”) with independent web designers (“Designers”). We help you find each other — but we are not a party to any agreement, project, or transaction that follows.
Importantly, Scope Flow does not provide web design services itself. We don’t build websites, and we don’t employ, supervise, or control the Designers on our platform. Any work is carried out under a separate agreement made directly between the Customer and the Designer.
Using the Service as a Customer
- Getting matched with Designers and receiving quotes is free, and you’re under no obligation to hire anyone.
- When you submit an enquiry, you agree that we may share your contact and project details with a limited number of matched Designers so they can quote on your project.
- You’re responsible for providing accurate information about your project and for evaluating any Designer before entering into an agreement with them.
- Any contract for work — including price, scope, timelines, and deliverables — is agreed directly between you and the Designer. Scope Flow is not part of that contract.
Using the Service as a Designer
- Designers must provide accurate information about themselves and their business, and comply with these Terms to receive and respond to enquiries.
- Designers pay to unlock and respond to leads. Details of pricing and any refund arrangements are set out at the point of purchase and in any separate Designer agreement.
- Designers are solely responsible for the services they provide to Customers, and for meeting their own legal, tax, and professional obligations.
- Designers must contact Customers only in relation to the enquiry they’ve unlocked, and must handle Customer information responsibly and in line with our Privacy Policy and applicable law.
No guarantee of outcomes
We work hard to make good matches, but we can’t and don’t guarantee:
- that a Customer will receive any particular number of quotes, or be matched at all;
- that any Designer will respond, quote, or be available;
- that a Customer will hire a Designer, or that a Designer will win any work;
- the quality, timeliness, or outcome of any work a Designer carries out.
The relationship, and any dispute about the work itself, is between the Customer and the Designer.
Your responsibilities
When using the Service, you agree that you will:
- provide accurate, current, and complete information;
- use the Service only for lawful purposes and in good faith;
- not misuse the Service, interfere with its operation, or attempt to gain unauthorised access to it;
- not use information obtained through the Service for any purpose other than the one it was provided for.
Intellectual property
All content on the Scope Flow website — including our name, logo, branding, text, and design — belongs to Scope Flow or its licensors and is protected by law. You may not copy, reproduce, or reuse it without our permission.
Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations about the Service, the Designers, or any work carried out, whether express or implied.
Nothing in these Terms is intended to limit or exclude any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply and cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Scope Flow will not be liable for any indirect, incidental, or consequential loss, or for any loss or damage arising from:
- your use of, or inability to use, the Service;
- any dealings, agreements, or disputes between Customers and Designers;
- the acts, omissions, conduct, or work of any Designer or Customer;
- any inaccurate information provided by a Customer or Designer.
Where liability cannot lawfully be excluded, our total liability to you is limited to the fullest extent permitted by law.
Suspension and termination
We may suspend or terminate your access to the Service at any time if you breach these Terms, misuse the Service, or where we reasonably consider it necessary to protect the Service or other users.
Changes to these Terms
We may update these Terms from time to time. When we do, we’ll revise the “last updated” date at the top of this page. Continuing to use the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of New Zealand, and any disputes relating to them will be subject to the jurisdiction of the New Zealand courts.
